Welcome to Crayola! This Privacy Policy describes the collection, use, disclosure, and other processing of personal information, both online and offline, of Crayola, LLC ("Crayola," "we" or "us"), through Crayola.com, CrayolaExperience.com, and any other website, product, feature, survey, or service we offer that posts or provides this Privacy Policy (collectively, the "Crayola Properties").  On the Crayola Properties, Crayola is the data controller responsible for processing your personal information.  By accessing or using the Crayola Properties, you agree that your access and use are governed by this Privacy Policy and our Terms of Use. If you do not agree, please do not use the Crayola Properties.

For purposes of this Privacy Policy, “personal information” refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you, and includes “personal data” or similar terms as used in applicable privacy or data protection laws.

Note: Crayola-branded services that do not post, link, or provide this privacy policy are not subject to it and are not considered among the "Crayola Properties" for purposes of this Privacy Policy. Notice at Collection of Personal Information

What personal information do we collect?  We collect the following categories of personal information:

  • Identifiers and contact details: We collect your name, email address, phone number, address, social media handle or username, IP address, and online identifiers associated with you, your device, or your browsing session on the Crayola Properties.
  • Demographic information (which may be considered a characteristic of a protected class under California or Federal law): We collect your age, date of birth, or gender.
  • Payment information (which is a category of personal information described in the California Customer Records statute): Your credit card or debit card number, or other form of payment.
  • Internet or other electronic network activity information:  We collect information about your activity on and use and browsing of the Crayola Properties.
  • Commercial information:  We collect information about the products or services you are interested in from Crayola or that you purchase from us, your responses to surveys, your marketing preferences, your publicly available comments regarding Crayola products, and your comments or product ratings for Crayola products.  When you participate in a market research opportunity such as an advisory panel or focus group, we may ask you to voluntarily provide additional information about yourself and your household, including use of Crayola or other products or services and product or service preferences.
  • Geolocation information:  We use your IP address to associate your browsing session with a geographical location.
  • Visual information:  We receive images of you or your artwork that you choose to submit to us.
  • Professional information:  We collect information from educators, including their current role and school affiliation.
  • Inferences:  We draw inferences from the above-listed categories of personal information about your preferences.
  • Other information: When you contact us, we may collect additional categories of personal information, including information you voluntarily provide or information we request to respond to your inquiry.

Certain types of data that we collect or generate are not considered “personal information” and are not subject to this Privacy Policy.  Examples include de-identified data, which cannot reasonably be used to infer information about or otherwise be linked to a particular individual, and aggregate information, which relates to a group or category of individuals from which individual identities have been removed.

What sensitive personal information do we collect?  Certain categories of personal information are considered “sensitive” or “special” under applicable privacy and data protection laws.  In particular, when you report an adverse incident related to the use of a Crayola product, we may collect health, allergy, or injury details in order to best address your report.  We use this information to maintain the quality of and improve our products or services.  We do not use or disclose your sensitive information for the purpose of inferring characteristics about you for any other purpose.

What is our approach to “sales,” “sharing,” or “targeted advertising” under U.S. state privacy laws?  When you access certain pages of the Crayola.com or CrayolaExperience.com websites, we may use technologies offered by third parties that include advertising networks, data analytics providers, and social networks to analyze your engagement with Crayola and the effectiveness of our marketing efforts, as well as to deliver targeted advertising.  Because our disclosure of identifiers, internet or electronic network activity information, commercial information, or inferences to these third parties may constitute a “sale,” “share,” or “targeted advertising” under applicable U.S. state privacy laws, we offer an option to opt out.  Please use the “Your Privacy Choices” button in the footer to opt out.  You may also choose to enable online, where available, a universal tool that automatically communicates your opt-out preferences, such as the Global Privacy Control (“GPC”).  We will process the GPC signal as a request to opt out.

How do we use the personal information that we collect and process?  We may use the personal information that we collect for the following business and commercial purposes:

  • Allowing you to use and interact with the Crayola Properties and the features we offer;
  • To process your payments and fulfill your orders, such as purchases of tickets at CrayolaExperience.com;
  • Contacting you about products and services we think you may be interested in, including special offers and promotions from us;
  • Tailoring our content, products, and services to you, including advertising, recommendations, promotions, and offers we display to you, both online and offline;
  • To communicate with you about your entry in a contest, sweepstakes, or similar;
  • To request your response to a survey about your experience or interaction with us;
  • To provide educators with products, information, resources, and experiences as part of our learning opportunities;
  • As part of a market research opportunity, including to request your participation in a market research opportunity and to solicit your feedback about products or services as part of such opportunity;
  • For internal business purposes, including operating the Crayola Properties, improving our products, services, and marketing endeavors, monitoring consumer sentiment, tracking emerging trends and preferences, and resolving technical issues reported about the Crayola Properties;
  • To analyze and improve our consumer interactions and engagement, including with automated tools, such as artificial intelligence, to help monitor communications, identify trends and sentiment, and support customer service and marketing activities, subject to human oversight.
  • Contacting you regarding your use of the Crayola Properties or your customer service inquiry to Crayola, including to respond to your request, request feedback from you, and to send you important updates and messages about changes to our Crayola Properties, this Privacy Policy, and/or other applicable terms and conditions;
  • Protecting the safety, rights, property, or security of Crayola, the Crayola Properties, consumers, and the general public, including investigating and preventing fraud, illegal activities, and activities that violate our policies;
  • To assess and respond to your adverse incident report regarding any allergic reaction or injury associated with product use;
  • To comply with applicable laws and regulations and respond to lawful requests and communications from law enforcement and other government officials;
  • To carry out sales and business transactions in which information held by us is among the assets transferred or is otherwise relevant to the evaluation, negotiation, or completion of the transaction; and
  • To fulfill any other purpose for which you provide your personal information or as explained to you at the point of information collection.

What is our data retention policy?  We will retain your personal information for as long as reasonably necessary to fulfill your request for information, for marketing purposes unless you opt out as described in our Privacy Policy, or otherwise where permitted or required in accordance with applicable law. We will retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. What this means in practice will vary between different types of information, and when we consider our approach we take into account ongoing business or legal needs for the personal information (e.g., where we require personal information for tax or health and safety purposes or to address potential or actual disputes or investigations).

Our Collection of Personal Information

As we describe in this section, we collect personal information about you directly that you choose to provide to us, automatically when you visit the Crayola Properties, and from third party sources.

Personal information you provide directly to us. When you use the Crayola Properties or otherwise interact with Crayola, we collect personal information directly from you in the following contexts:

  • When you contact Crayola: We collect personal information when you contact us, including with a customer support inquiry or to share feedback about Crayola products or services.
  • When you participate in a contest, sweepstakes, or other promotion:  From time to time, we may make available various types of promotions on the Crayola Properties, on social media, or in other contexts.  We may ask you to provide personal information to participate in a promotion.
  • When you post a review, comment, or other feedback on Crayola social media properties, we may collect and review this feedback.
  • When you participate in a market research opportunity, we may collect personal information to facilitate your participation and to ask you questions about your experience with Crayola products.
  • When you provide us with an image, including when you upload an image to generate a custom coloring page, share images of your artwork, or provide an image related to an adverse event.
  • When you provide a response to a survey or quiz.
  • Information about third parties:  When you participate in market research opportunities, we may ask you to provide information that you know about other members of your household, their preferences, and their experiences with Crayola or other products.

Personal information we collect automatically.  When you visit and interact with the Crayola Properties, we or our service providers or third-party partners may use a variety of technologies, such as cookies, tags, SDKs or scripts, to collect certain information regarding your activity.  For example, we may collect the following information: 

  • Device and Browser Information. This includes your device’s IP address and/or other unique identifiers, browser type, device type, internet service provider, and operating system.
  • Location Information. When you access the Crayola Properties, your device’s approximate location derived from your device’s IP address or other signals may be collected.
  • Usage Information. When you interact with the Crayola Properties, we or our service providers may collect information such as the date and time of your visit, the pages you view immediately before and after you access the Crayola Properties, the areas or pages of the Crayola Properties that you visit, the amount of time you spend viewing or using the Crayola Properties, keystrokes, mouse movements, session interactions, form field entries, recordings of chat sessions, and other use and overall engagement with us.
  • Marketing Information. If you receive an email from us, information may be collected about your interactions with the message (e.g., whether you opened, forwarded, or clicked through to the Crayola Properties).
  • Analytics.  We may use analytics tools to better understand who is using the Crayola Properties, how people are using them, and how to improve their effectiveness as well as the effectiveness of any related content. For example, we implement Google Analytics cookies to collect personal information about you when you visit our website for purposes of demographic and interest reporting. You can opt-out of the use of this technology through the Google Analytics opt-out browser add on.

Cookies and Other Similar Technologies. Crayola uses cookies or other similar technologies such as tags, local storage objects, SDKs, scripts when you visit the Crayola Properties on the internet.  We use these technologies for a variety of purposes, including to store a unique identifier for your device that recognizes your device as you visit the Crayola Properties or other websites or online services, to remember your preferences, make your navigation of our websites more efficient, enhance your browsing experience, improve the use and functionality of our websites and related content, and enable the delivery of relevant and personalized advertisements to you across the internet.  More specifically, we and our service providers and third-party partners use strictly necessary cookies that support basic functionality of our websites, performance cookies that collect information about how visitors use our websites, functional cookies that allow for enhanced and personalized features on the websites, and advertising cookies that are used to show you relevant ads on other online services by observing your activity on our websites and across other websites or platforms.

When third parties place cookies or similar technologies on your device, these third parties may combine the information that they collect using these technologies with information from other sources and use the combined information for analytics or advertising purposes.

Personal information we collect from third parties. We may receive information about you from third party sources, including:

  • Our business partners, including companies that assist us with online marketing or analytics efforts; and
  • Data providers who enhance the information we have about you or provide us with publicly available information about you.

In addition, when you use a social media service, such as Facebook, Twitter, YouTube, Pinterest, and Instagram, or when you interact with Crayola advertising on third-party websites or apps, the social media network or publisher of the website or app may collect information about your activity and share this information with us.  Please review the privacy policy and applicable terms governing your use of any third-party website, app, or social media network where you interact with Crayola, because they may differ from the terms of this Privacy Policy.

Combination of personal information.  We may combine personal information that we receive from various sources. For example, we may combine personal information that we collect from you offline with personal information we collect from you through the Crayola Properties. Similarly, we may combine personal information that we receive from third parties with personal information we already have about you. We use, disclose, and protect combined personal information as described in this Privacy Policy.

Our Disclosure of Personal Information

We may disclose each category of personal information that we have collected from and about you to the following categories of recipients: 

  • Our Service Providers. We disclose your personal information to our service providers or other trusted third parties that provide business, professional, marketing, data analytics, or technical support services to us, help us operate our business and the Crayola Properties, or administer activities on our behalf. Examples include using a payment processor, customer service provider, email marketing provider, delivery services, data-analysis provider, and other administrative service providers. 

  • Our Affiliates.  We may share your personal information with our parent, affiliates, and subsidiaries for business, analytical, and operational purposes. 

  • Crayola Experience Operators.  We may disclose certain personal information about your purchase of an annual pass or ticket with operators of Crayola Experience locations in order to facilitate your admission to such locations. 

In certain circumstances, we may disclose each category of your personal Information to: 

  • Competent Governmental, Regulatory, and Public Authorities. We may disclose your -personal information to government and law enforcement authorities, in each case to comply with legal or regulatory obligations or requests.  

  • Relevant Third Parties as Part of a Corporate Transaction. In the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with a bankruptcy or similar proceeding), we may disclose or transfer your personal information to certain third parties, such as the acquiring entity and its advisers. 

  • Other Third Parties. We will disclose your personal information to other third parties at your direction or with your consent. Additionally, we will disclose your personal information as we believe necessary or appropriate to: (a) comply with applicable law; (b) enforce our terms and conditions; (c) protect our operations; (d) protect our rights, privacy, safety, or property, and/or those of others; (e) in an emergency, to protect the health and safety of individuals or the general public; and (f) allow us to pursue available remedies or limit damages that we may sustain.  

We may disclose your personal information for other reasons that we will describe at the time of information collection or prior to disclosing your information.  

When you participate in a sweepstakes, contest, or other promotion (“Promotion”), the official rules or other terms governing the Promotion may contain specific requirements of you (including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing materials). If you choose to enter a Promotion, personal information may be disclosed to third parties or the public in connection with the administration of such Promotion, including in connection with winner selection, prize fulfillment, as required by law, or as permitted by the Promotion's terms or official rules (such as on a winner’s list). 

In addition, as disclosed above in the Notice at Collection, when you access certain pages of the Crayola.com or CrayolaExperience.com websites, we may use technologies offered by third parties that include advertising networks, data analytics providers, and social networks to analyze your engagement with Crayola and the effectiveness of our marketing efforts, as well as to deliver targeted advertising.  Our disclosure of identifiers, internet or electronic network activity information, commercial information, or inferences to these third parties may constitute a “sale,” “share,” or “targeted advertising” under applicable U.S. state privacy laws.   

Please note that we may de-identify or aggregate personal information so that it will no longer be considered personal information and disclose such information to other parties for purposes consistent with those described in this Privacy Policy. 

Your Privacy Rights and Choices

Crayola provides you a number of choices with respect to how we collect and process your personal information, as described below. 

U.S. Privacy Rights.  Depending on your U.S. state of residence, under applicable law, you may have certain rights in relation to your personal information. 

The following rights are available to residents of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Texas, Tennessee, Utah, Virginia, or any other state with an applicable privacy law relating to the collection, use, disclosure, and other processing of their personal information. The exact scope of these rights may vary by state.   

  • Right to Know: You have the right to know what personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, the categories of personal information disclosed to third parties, and the specific pieces of personal information we have collected about you. You have the right to access this information in a portable format.  

  • Right to Delete: You have the right to request that we delete the personal information we have collected from or about you, subject to certain exceptions.  

  • Right to Correct: You may have the right to correct inaccurate personal information that we maintain about you, subject to appropriate verification. 

  • Right to Opt Out:  Because we may disclose personal information to third parties in certain analytics or advertising contexts, you have the right to opt out of “sales,” “sharing,” and “targeted advertising” as such terms are defined in applicable privacy laws. 

The following right is available to residents of Connecticut, Minnesota, and Oregon: 

  • Right to Request Specific List of Third Parties:  You have the right to request a list of the specific third parties with whom we have shared or sold personal information.  

Exercise your privacy rights.  If you are interested in exercising your right to know, delete, or correct your personal information or to request a specific list of third parties, please contact us at [email protected] or toll free at 1-800-CRAYOLA (1-800-272-9652).  Please put the statement “U.S. Privacy Rights” in the subject field of your email.  We may take steps to verify your identity before responding to your request by asking you a series of questions about your previous interactions with us. Submitting a privacy rights request does not require you to create an account with us. 

If you are interested in exercising your right to opt out, please click the “Your Privacy Choices” link in the footer of this website or other Crayola Properties.  Submitting a request to opt out does not require you to create an account with us.  Alternatively, you can use browser-based preference signals to exercise your opt-out request automatically with all businesses with whom you interact online, including Crayola. If you enable an opt-out preference signal, such as the Global Privacy Control (GPC), upon receipt or detection, we will treat the signal as a valid request to opt out of sales, sharing, and targeted advertising for the browser and any consumer profile we have associated with that browser. Please note that if you use different browsers or devices, you may need to enable the signal on each browser or device. 

Only you, or someone legally authorized to act on your behalf, may submit a request related to your personal information.  You may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf. We retain the right to request confirmation directly from you confirming that the agent is authorized to make such a request.  

You will not receive retaliatory or discriminatory treatment in connection with your exercise of your privacy rights. 

Right to Appeal.  Depending on your state of residence, you may have the right to appeal decisions we have made in connection with your privacy rights described in this section. To appeal a denial of your privacy request, please contact us at [email protected]

Notice of Financial Incentive. We may offer financial incentives to promote our products and services, including discounts, coupons, or special offers, when you sign up for our email list or participate in a Promotion.  We may ask you to provide personal information in connection with these Promotions, including identifiers, contact information, demographic information, or professional information.  We use your personal information as described in this Privacy Policy.  Because these promotions involve the collection of personal information, they may be interpreted as “financial incentive” programs or “bona fide loyalty programs” under applicable law.  

Participation in any financial incentive is always optional.  The terms of a Promotion are communicated to you at the time that you choose to participate.  You may withdraw from a financial program at any time by following the instructions provided in our communications to you or by emailing us at [email protected].  If you exercise your right to delete your personal information, we will not be able to provide you with access to these Promotions. 

The value of any financial incentive we offer is reasonably related to the value of any personal information you provide to us. We estimate the value of your personal information by considering, without limitation, the expenses we incur from collecting your personal information and/or providing the financial incentive to you, and the revenue generated by your use of the financial incentive. 

Marketing and Promotional Communications.  From time to time, we or our affiliates may send you marketing and promotional communications. If you no longer wish to receive promotional and marketing emails, you may opt out as follows: 

  • Email. You may unsubscribe from marketing emails we send you through the opt-out mechanism included in each email. 

  • Text Messages. If you sign up to receive SMS or MMS messages from Crayola, you may unsubscribe by replying “STOP,” “CANCEL,” “UNSUBSCRIBE,” or “END.” 

You may opt out of these disclosures by emailing us at [email protected]. Please note that if you are already receiving marketing communications from one of our affiliated companies, you will need to opt-out directly with that company to stop receiving their messages. 

Interest-Based Advertising.  You may elect to take advantage of advertising industry opt-out tools available at the following links:  https://youradchoices.com/control (for U.S. residents); https://youronlinechoices.eu/ (for EU residents); and http://youradchoices.ca/ (for Canadian residents).  When you use these tools, you will need to opt out separately on all of your browsers and devices, as each opt out will apply only to the specific browser or device from which you opt out. If you delete or reset your cookies or mobile identifiers, change browsers, or use a different device, any opt-out cookie or tool may no longer work, and you will have to opt out again.  Even if you choose to opt out of receiving interest-based advertising, you may still receive advertising, but the advertisements may be less relevant.  

Additional Notice for Non-U.S. Residents

For residents of the European Economic Area, UK, Canada, Mexico, and Australia, Crayola is the controller responsible for processing your personal information.  

Lawful Basis. Applicable law in certain jurisdictions requires us to set out the “lawful basis” that we rely on to collect and use your personal information. Where applicable, the lawful bases upon which we rely on to collect and use your personal information are as follows: 

  • Consent.  We may collect, use, and disclose your personal information based on the consent that you provide us at the point of information collection or disclosure. You have the right to revoke your consent at any time.  

  • Contractual Necessity. We may collect and use certain personal information where it is either necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract. This may include personal information used to provide you with our products and related services and related transaction information.  

  • Compliance With Legal Obligation. We are subject to various legal requirements in the jurisdictions in which we operate, and we may use, disclose, and retain your personal information if necessary for us to comply with a legal obligation arising under an applicable law to which we are subject.   

  • Legitimate Interests. We may collect and use your personal information to the extent necessary to carry out our legitimate interests (or those of a third party), provided that such interests do not outweigh your interests or fundamental rights and freedoms. For example, we may collect and use your personal information in reliance on a legitimate interest in managing our relationship with you; conducting and managing our business; providing you with customer support; conducting market research; developing and enhancing our services; detecting and preventing fraud and other harmful activities; and monitoring and maintaining the security of our data, systems, and networks.  

Privacy Rights and Requests. You may have certain rights related to your personal information, including:  

  • Right to Access. You have the right to request access to, or copies (and transmission) of, the personal information we hold about you and the purposes for which we are using it. 

  • Right to Rectify. You have the right to correct inaccurate personal information that we have collected from and maintain about you, subject to appropriate verification.  

  • Right to Erase. You have the right to erase personal information pertaining to you, under certain conditions. We will assess any deletion request after verifying your identity and work to respond within one calendar month and let you know if we need additional time.  

  • Right to Object. You have the right to object to our processing of your personal information, under certain conditions.  

  • Right to Restrict. You have the right to restrict the processing of your personal information, under certain conditions.  

  • Right to Data Portability. You have the right to receive the personal information we have collected from you. Under certain conditions, you may request that we transfer your personal information to another organization, or directly to you.  

At any time, you may request or assert any of the rights above by emailing us at [email protected].  You may have the right to lodge a complaint about our data collection and processing actions with the supervisory authority concerned. 

International Transfers.  Crayola is a global business and it, or its service providers, may process, transfer, and store information about you on servers located outside your country, such as in the United States.  In some of these locations, data protection laws may be less stringent than in your country.  To ensure that your personal information is adequately protected, we only transfer your personal information subject to suitable safeguards being in place.  Where we transfer your information outside the EEA or UK, and where required by law, we implement an approved data transfer mechanism in place, such as the standard EU contractual clauses. 

Children's Privacy

The Crayola Properties are intended for a general audience.  We do not knowingly collect personal information of individuals under the age of 13 or sell or share personal information of individuals under the age of 18.  As noted above, Crayola may offer apps and other online services that are directed to children and are not governed by this Privacy Policy.  Please click here to access privacy policies associated with these apps or online services. 

Third-Party Content and Links

The Crayola Properties may contain content that is served by someone else or links to third-party content or websites. Crayola does not control this content or these sites. The third-party operators and content providers use their own cookies or other tracking technologies, and they may independently collect information from or about you. Crayola is not responsible for the privacy practices employed by any third party. 

Information Security

Crayola takes commercially reasonable steps designed to secure your personal information; however, no data transmission over the internet, wireless transmission, or electronic storage of information can be guaranteed to be 100% secure. As such, Crayola cannot ensure or warrant the security of any information we collect and cannot guarantee protection of all information against interception, misappropriation, misuse, or alteration, or that your information may not be disclosed or accessed by accidental circumstances or by the unauthorized acts of others. You use the Crayola Properties and provide us your personal information at your own risk. 

Changes to this Privacy Policy

To the extent allowed by applicable law, we reserve the right to change this Privacy Policy at any time without prior notice. If we make material changes to this Privacy Policy, we will update the effective date and notify you by temporarily noting “UPDATED” next to the Privacy Policy link in the footer of the Crayola Properties, or by contacting you through the information you have provided. Your continued use of any of the Crayola Properties after the effective date of the revised Privacy Policy will constitute your consent to those changes to the fullest extent allowed by applicable law and your agreement that all personal information collected from or about you after the revised Privacy Policy is posted will be subject to the revised policy.
